General terms of supply

This is an English translation provided for convenience; in the event of any discrepancy, the Italian version prevails. Different terms, unless expressly stated in writing on documents issued by 3G Electronics S.r.l. (price lists, quotations, order confirmations or otherwise), are not accepted. The ordered goods will be shipped only once the Customer has accepted and signed these terms of supply.

1) Prices

The prices stated on documents issued by 3G Electronics S.r.l. – price list, quotations, confirmations – whether net of VAT or VAT included, as will be specified, are valid within the time limits and under the conditions stated on the individual documents.

2) Delivery (carriage)

Except where otherwise accepted in writing by 3G Electronics, delivery is understood to be carriage paid to destination throughout Italy, with transport and insurance costs borne by the customer, amounting to 0.7% (zero point seven per cent) of the value of the goods, with a minimum of €15.00.

3) Lead times

Products with “available subject to prior sale” delivery are made available for delivery, except in cases of force majeure, in the shortest possible time, if still available at the time of the order and provided the General Terms of Supply have already been signed and the order complies with them. For products not held in stock, 3G Electronics S.r.l. will confirm the lead times as soon as possible.

In the case of orders containing several items, the goods will be shipped in a single consignment, unless the acceptance of partial deliveries is expressly indicated at the time of the order. Invoicing will take place in accordance with the legal provisions in force. In the event of delayed or missed deliveries, the liability of 3G Electronics S.r.l. is limited to any cancellation of the order by the customer.

3G Electronics S.r.l. reserves the right to suspend supplies temporarily or permanently in the event of delayed payments relating either to the current supply or to previous supplies.

4) Complaints

In the case of “carriage paid to destination” delivery, the Customer is required to check the integrity of the packaging and that the contents correspond to what is indicated on the accompanying delivery note. Any complaints must be notified in writing, by e-mail (3gelectronics@treg.it) to 3G Electronics S.r.l. within and no later than 3 working days of receipt of the goods. Complaints made beyond this term will not be accepted.

Any return of the disputed goods must be authorised by 3G Electronics S.r.l., which will issue a return authorisation number that must be indicated on the accompanying documents and highlighted on the external packaging. The goods must be returned via a courier under agreement with 3G Electronics, as indicated on the return authorisation, which will arrange collection at no further cost to the Customer.

The Customer is in any case strictly required to prepare the material to be returned in its original packaging, always containing all accessory parts unless otherwise indicated by 3G Electronics S.r.l. (manuals, cables, disks, CD-ROMs, etc.) and in adequate external packaging that protects the contents from impacts during transport. Otherwise, 3G Electronics S.r.l. will raise a written dispute, with the customer being obliged to compensate for the damage up to the entire value of the returned material.

5) Features, functionality and quality

The features, functionality and quality of the products supplied are guaranteed by the manufacturers and, unless otherwise indicated in writing, the products are supplied in original packaging including everything necessary for correct use of the product.

The performance and operation of the products supplied comply with what is specified in the relevant technical documentation. Instructions for the correct installation of the products and the use of any peripherals are contained in the technical documentation and supplemented by the information available on the manufacturers' websites and on the website www.3gelectronics.it.

Any disputes must be raised within 7 days of the date of delivery: subsequent complaints will fall within the terms provided for the warranty of each individual product and may not give rise to delays in or suspension of payments.

Products relating to orders fulfilled with advance payment, if disputed within 7 days of delivery, may be returned to 3G Electronics S.r.l. with a refund of the amount paid, with the exception of transport costs (if paid): the return procedures follow the same steps specified in the previous clause. The products must be returned intact in all their parts (manuals, cables, disks, CD-ROMs, etc.) and in their original packaging: otherwise the refund will be partial, deducting the cost of the missing and/or damaged parts, which will be disputed in writing, up to the entire value of the returned products.

6) Limited liability

The features and functionality of the products are those indicated in the technical documentation accompanying the products, supplemented and updated by the information available in the technical support sections of the manufacturers' websites.

The products must be managed (i.e. installed on compatible Personal Computers and Workstations or connected to other devices, or integrated into local or public networks, according to the manufacturers' instructions) by competent and experienced personnel. 3G Electronics S.r.l. is in no way responsible for the installation and correct operation with peripherals and/or in networks/the internet.

In the event of an established fault and/or malfunction of the product sold by 3G Electronics, the liability and burden on 3G Electronics S.r.l. are limited to arranging the repair or replacement according to the warranty procedures in force.

Should the Customer dispute the features and performance of the product, declaring them not to meet specific requirements, 3G Electronics S.r.l. reserves the right to assess the disputes and, on an exceptional basis, to accept the return of the product sold, refunding the price paid partially or in full. In such cases, no liability may be attributed to 3G Electronics S.r.l., including in relation to any alleged damage for lost profits or other damages attributable to claimed insufficient technical/functional features.

7) Place of jurisdiction

The Court of Milan has jurisdiction over any dispute that may arise regarding the interpretation and performance of these General Terms of Supply.
